Terms and conditions

1. Scope of applicability

1.1. These terms and conditions apply to contracts for the rental of guest rooms and holiday flats for lodging purposes, as well as all other services provided to the customer by Orangerie de Cardet (hereinafter referred to as "OdC").

1.2. A prior written consent of OdC is required for the subletting or reletting of the premises provided as well as their use for purposes other than accommodation..


1.3. The guest's general terms and conditions shall only apply if these are expressly agreed in writing in advance

2. Conclusion of contract

2.1. The contract is concluded by the acceptance of the customer's request by the OdC. The OdC is free to confirm the reservation in writing.

2.2. The contracting parties are OdC and the customer. If a third party placed the order on behalf of the guest, it is liable to OdC together with the guest as joint and several debtors for all obligations arising from the contract.

3. Services & prices

3.1. Services included

3.1.1. The services included in the prices include water, firewood, bed linen, hand and bath towels (for exclusive use within the accommodation), available children's toys and board games. A baby cot, high chair and baby bath are available free of charge on request and subject to availability.


3.1.2. The prices quoted include the respective statutory value added tax. OdC is obliged to collect the local applicable tourist tax and pay it to the appropriate authority. This tax is contractually and is due on arrival at the latest.

3.1.3. The use of electricity is included in the prices of the guest rooms for the entire year. The use of electricity is included in the prices of the holiday flats during the period 01.04.-30.09.

3.1.4. The prices of the guest rooms include an intermediary cleaning after every 4th night.

3.2. Additional services

3.2.1. The use of electricity is not included in the holiday flats' rental prices in the period 01.10.-31.03.
A flat rate of € 4.00 per person/night is charged for this.

3.2.2. For the holiday flats an intermediate cleaning can be requested. The costs amount to 50% of the final cleaning costs agreed in the contract. A change of linen can be booked at extra cost.

4. Payment

4.1. Guest room
For bookings of individual guest rooms, the time of payment depends on the chosen rate

4.2. Holiday flats
The following payment conditions apply for booking a holiday flats:
If booked
more than 3 months before arrival:

1st installment = 20% of the total amount at the time of booking
2nd installment = 40% of the total amount
up to 3 months before arrival 
3rd installment = 40% of the total amount
up to 1 month before arrival

In case of reservation less than 3 months before arrival:

1st payment = 60% of the total amount at the time of booking
2nd payment = 40% of the total amount up to 1 month before arrival

In case of reservation 1 month or less before arrival:

The total amount must be paid immediately after receipt of the booking confirmation.

5. Cancellation / Withdrawal

5.1. Cancellation by the host

5.1.1. For bookings of individual guest rooms, the possibility and timing of a cancellation/withdrawal depends on the chosen rate.

5.1.2. When booking the gîtes, the following cancellation conditions apply:

- in case of cancellation between the time of booking and 3 months before arrival, a fee of 20% of the total amount will be charged.
- in case of cancellation
between 3 and 1 month before arrival, a fee of 60% of the total amount will be charged.
- in case of cancellation
less than one month before arrival, a fee of 100% of the total amount will be charged.

Any cancellation by the customer must be made in writing, by e-mail or by letter.


5.2. Withdrawal by the OdC

5.2.1. o the extent that a right of cost-free cancellation within a certain period was agreed in writing for the guest, the hotel is entitled for its part to cancel the contract during that period if there are inquiries from other guests regarding the contractually reserved rooms and the customer does not waive his right of rescission upon inquiry thereof by the OdC.


5.2.2. If a contractually agreed advance payment is not effected and if this is still not effected after a single reminder, OdC is also entitled to withdraw from the contract. In this case, OdC is entitled to retain the deposit already paid by the customer and to rent the premises to other guests.

5.2.3. Furthermore, OdC is entitled to withdraw from the contract extraordinarily for an objectively justified reason, for example if:
a) force majeure or other circumstances for which the OdC is not responsible make it impossible to fulfill the contract; 

b) rooms are booked under misleading or false statements of material facts,
e.g. in the person of the guest or the purpose of his stay;
c) there is a violation of one of the points named in the GTCs



In the event of justified withdrawal by OdC, the customer shall not be entitled to claim damages. 

Any withdrawal by the OdC requires the written form, via email or letter.

6. House rules

6.1. It is forbidden to smoke in the accommodation. We are happy to provide ashtrays on the terrace.
In case of disregard, a special cleaning fee of € 150.00 will be charged.

6.2. Eating is not permitted in the guest rooms and in the bedrooms of the holiday flats.

6.3.
The use of confetti and sequins is prohibited in all spaces, whatever the event.

6.4. Pets are welcome. (Handling and fees - see point Pets.

6.5. Out of consideration for other guests and neighbours, we ask that you respect the hours of silence from 10 p.m. to 8. a.m.

6.6. Parties with loud music are not allowed.

6.7. The pitching of tents or the parking of campervans and caravans is prohibited on the grounds unless the OdC has given its consent.

7. Pets

7.1. Pets in guest rooms
A maximum of 1 pet can be brought per guest room. Due to the additional effort for the final cleaning, a service fee of € 5.00 per pet/night will be charged per dog/cat. For small animals, which are to be kept exclusively in a cage, there are no additional costs.


7.2. Pets in the gîtes
Up to two pets per holiday flat can be brought along. Due to the additional effort for the final cleaning, a service fee of € 8.00 per pet/night will be charged per dog/cat. There are no additional costs for small animals, which are to be kept exclusively in a cage.

All pets must be supervised while staying in the garden. Use of the garden as a toilet is not permitted. The responsibility for the removal of possible excrements lies with the respective owner.
If leaving the pet alone in the accommodation causes noise nuisance to other guests, OdC may prohibit the guest from leaving his pet alone in the accommodation.


Category 1 and 2 dogs must be kept on a lead only.
The license to keep these animals must be carried and presented on request.

8. Visitors

Persons staying on the premises during the day and not staying overnight on site must be registered at least one week before their arrival. A visitor's fee of € 5.00 per person/day will be charged, which will be deducted from the deposit.

9. Security deposit

For each guest room, a deposit of € 80.00 is required. The deposit can be paid either up to 7 days before arrival by bank transfer, by credit card authorisation or in cash on the day of arrival.

For each holiday flat a deposit of € 300.00 is to be paid. The deposit can be paid either up to 7 days before arrival by bank transfer, by credit card authorisation or in cash on the day of arrival.


If the deposit has been paid in cash or by bank transfer, it will be refunded by bank transfer no later than 10 days after departure, provided no damage has been found. Credit card authorisations are automatically released 7 days after departure. 


The security deposit may not be considered by the guest as a participation in the payment of rent. It serves in the event of damage caused by the guest.

If the amount of the losses exceeds the amount of this deposit, the guest undertakes to pay the damage after the inventory has been made at the time of departure or later discovery, which will take up to 10 days, and before any new letting.

Should damage caused by the guest restrict or render impossible the new rental, the guest shall be liable for the loss including all compensation which OdC must pay to any new guest in order to satisfy the latter.
The OdC undertakes to justify an amount necessary for the restoration of the gîte.

10. Availability/Return

10.1. Arrival
The booked accommodation is available to the guest from 16:00 on the day of arrival. The accommodation shall be made available in a fully cleaned and disinfected (all contact surfaces) condition. Applicable to the holiday flats: If the guest notices already existing damages upon arrival, a report has to be made to OdC within 24 hours.


10.2. Departure
On the day of departure, the accommodation must be vacated by 10:00 a.m. at the latest.
Applicable to holiday flats: The return requires in a broom-clean condition. The guest is responsible for clean and tidy crockery, the disposal of rubbish bins and the cleaning of the barbecue.
The customer is responsible for treating the accommodation with care and returning it in the same condition as it was taken over. The guest is responsible to OdC for any damage to the accommodation that occurs during his/her stay. Any damage to the furnishings, textiles or utensils must be reported to OdC by the time of departure at the latest.

An earlier arrival or a later departure are possible subject to availability by arrangement. Costs may be incurred for this.

11. Liability

OdC cannot be held liable for accidents of any kind on the premises or elsewhere

OdC is not liable in the case of theft or damage to the client's property. After handing over the keys, the client is solely responsible for the safekeeping and securing of his property.

12. Final provisions

12.1. Amendments or supplements to the contract, the acceptance of the application or these General Terms and Conditions must be made in writing. Unilateral amendments or supplements by the guest are invalid.
 

12.2. These General Terms and Conditions are governed by French law.Art. R211-5 BIS R211-14 of the Tourism Act.
